End-User License Agreement (EULA) of Totly

This End-User License Agreement ("EULA") is a legal agreement between you and Plus Mobile Apps LLC.

This EULA agreement governs your acquisition and use of the Totly software ("Software") and the hosted backend, accounts, sync, family sharing and any other online services operated by Plus Mobile Apps LLC that the Software connects to (the "Service").

Please read this EULA agreement carefully before installing and using the Totly software. It provides a license to use the Software and Service and contains warranty information and liability disclaimers.

By installing and/or using the Totly software, you are confirming your acceptance of the Software and agreeing to become bound by the terms of this EULA agreement. If you do not agree with the terms and conditions of this EULA agreement, do not install or use the Software.

Not Medical Advice

Totly is a record-keeping tool. Growth percentiles, reports and anything else the Software shows are for your information only and are not medical advice. Always consult your pediatrician or another qualified health professional about your baby's health, feeding, growth or medication.

License Grant

Subject to your compliance with this EULA, Plus Mobile Apps LLC grants you a personal, non-transferable, non-exclusive, revocable license to install and use the Software and to access and use the Service on devices you own or control.

You are responsible for ensuring your device meets the minimum requirements of the Totly application.

You are not permitted to:

  • Edit, alter, modify, adapt, translate or otherwise change the whole or any part of the Software, nor permit it to be combined with or incorporated into any other software
  • Decompile, disassemble or reverse engineer the Software or attempt to do any such things
  • Use the Service in any way that breaches any applicable local, national, or international law, or that infringes the rights of any third party
  • Interfere with, disrupt, or attempt to gain unauthorized access to the Service or to any account, server, or network connected to the Service
  • Use the Service to send spam, harassment, or other abusive content
  • Resell, sublicense, or commercially redistribute the Software or access to the Service

Intellectual Property and Ownership

Plus Mobile Apps LLC retains all right, title, and interest in and to the Software and the Service, including the "Totly" and "Plus Mobile Apps" names, logos and associated brand assets. You own the information you enter into Totly.

Termination

This EULA agreement is effective from the date you first use the Software and shall continue until terminated. You may terminate it at any time by deleting your account and uninstalling the Software.

It will also terminate immediately if you fail to comply with any term of this EULA agreement. Upon such termination, the licenses granted by this EULA agreement will immediately terminate and you agree to stop all access to and use of the Software and Service. The provisions that by their nature continue and survive will survive any termination of this EULA agreement.

Governing Law

This EULA agreement, and any dispute arising out of or in connection with this EULA agreement, shall be governed by and construed in accordance with the laws of the United States.
